Terms of Use and User Agreement

ConsimWorld.COM, including but not limited to the CSW Forum, is a place where you can actively tap the knowledge of the historical gaming community amongst hobby enthusiasts, game designers, military historians, and participating publishers alike.

We have created a place where members of our electronic community feel welcome to participate in discussions, to seek and share information, to listen and to speak out.

The basic ground rules for discussions are fairly simple: Register using your real first and last name, keep it clean, save any personal attacks for elsewhere, keep it civil and don't break the law. For our part, we don't intend to censor notes based on the opinions expressed within those notes but we will enforce the policies outlined elsewhere in this document.

In some circumstances we will remove from public view notes that conflict with these guidelines. In those cases we will attempt to explain to the poster why the note was moved. However, we reserve the right to move or remove notes at our discretion and without explanation.

By accessing ConsimWorld, the user acknowledges and agrees that:

• ConsimWorld encourages a free and open exchange of ideas in a climate of mutual respect. Any action by a participant that infringes on another participant's right to use and enjoy consimworld.com is prohibited. Participants agree not to harass other person or any member of their family, including by the posting of any information or link or other citation to information in violation of this pararaph or paragraphs 8 or 9 below, or knowingly display any false, defamatory, abusive, obscene, threatening, racially offensive, sexually explicit or illegal material on the service. This includes material placed in but not limited to (i) the second line of information viewable under the username when posting (also known as the "signature" line), or (ii) the Personal Information page.
• There are expressive limitations regarding the second line of information viewable under the username when posting to avoid "grandstanding". This area is to be used by members to present general information about themselves; such as location of residence, games played/purchased, books read, game club affiliation, etc. It is not meant to be used as a platform to display information outside of the hobby that may be construed as controversial in nature to others (such as a member's political or religious viewpoint). Exception: Given the common and accepted practice for the second line of information to display a quote attributable to a famous person or celebrity figure, we will permit added leeway in not limiting expression unless it is cited as offensive by our members.
• ConsimWorld reserves the right to move or delete any material deemed unacceptable under these guidelines and to limit or terminate service to participants who violate the terms of this agreement.
To register a complaint about another participant's conduct, please send an e-mail message to kranz@consimworld.com.
• Participants are expected to post messages on-topic relating to the discussion established. If an off-topic posting is discovered, ConsimWorld.COM may remove that message at its own discretion and at any time. Repeated off-topic posting offenses by any participant may result in services to that member being limited or terminated.
• Participation in discussions occurs in real time. ConsimWorld.COM cannot and does not intend to screen messages in advance. However, if a message is posted that violates the policies listed here, ConsimWorld.COM may remove that message at its own discretion at any time.
• Except where and when specifically permitted by ConsimWorld.COM, you may not upload any messages anonymously or under a false name. Nor may you permit any other person (other than a secretary, assistant or other agent acting on your behalf and subject to your supervision) to access ConsimWorld discussions for any purpose using your account, ID or password.
• Participants may not reproduce the contents of any private e-mail correspondence without the expressed prior consent of the party involved.
• Participants in ConsimWorld.COM discussions should ensure their email address is current (view/change your email address by selecting the PREFERENCES button once logged in).
• Participants in ConsimWorld.COM discussions may not post any information that is libelous or defamatory or that discloses private or personal matters concerning any person. They may not post messages or links to data, images or programs that are obscene or pornographic.
• Participants in ConsimWorld.COM's discussions may not use these discussions as a forum for hate speech. It is not consimworld.com's intent to discourage participants from taking controversial positions or expressing vigorously what may be unpopular views. However, ConsimWorld reserves the right to remove uploads containing racial, ethnic or religious slurs or similar epithets, or advocating violence, or other language that is deeply and widely offensive. In addition, consimworld.com reserves the right to take such other action as it deems appropriate in such cases, including the termination of access.
• Participants in ConsimWorld.COM discussions may not upload any messages, data, images or programs that would violate the property rights of others, including unauthorized copyrighted text, images or programs, trade secrets or other confidential proprietary information, and trademarks or service marks used in an infringing fashion.
• Except where expressly permitted by consimworld.com, participants may not use consimworld.com discussions to publish any information, software or other content that contains any charity requests, advertising or any solicitation of other members to use goods or services, without prior express approval of an authorized agent of consimworld.com. Discussion hosts are not authorized agents of consimworld.com.
• Participants in consimworld.com discussions may not use the facilities and capabilities of consimworld.com to conduct any activity or solicit the performance of any illegal activity or other online activity that infringes the rights of consimworld.com.
• In light of its policy of encouraging candid, open exchanges of views and the rapid distribution of information originating from many sources, consimworld.com cannot determine the accuracy of information that may be uploaded to consimworld.com. Accordingly, consimworld.com cannot and does not guarantee the accuracy or completeness of any database on consimworld.com, of the information contained in any such database or of any statement uploaded to consimworld.com discussions by any participant.
• Consimworld does not endorse and is not responsible for any statement, opinion, advice given or made on consimworld.com by anyone other than authorized consimworld.com spokespersons. Experts and discussion hosts on consimworld.com are not authorized spokespersons.
• Opinions, advice and all other information expressed by participants in consimworld.com discussions are those of the author. You rely on such information at your own risk. Participants are urged to seek professional advice for specific, individual situations and not rely solely on advice or opinions given on consimworld.com.
• (updated 5/8/2005)ConsimWorld is not responsible for the actions taken independently by discussion hosts which may include editing or removing member postings or topics at their own discretion. Discussion hosts may include representatives of a participating game publisher/guest in their game company support area or related game title discussion topic, and they are asked to announce any posting deletions as a courtesy to our members. Discussion hosts are not authorized agents of consimworld.com.
• ConsimWorld encourages all discussion hosts to promote open and positive discussion, free of censorship unless falling under any of the restrictions listed herein or being considered off-topic in nature. Consimworld requires that discussion hosts fully disclose when they have made use of their moderator rights to edit or remove a posting, and on what grounds. Discussion hosts are encouraged to contact ConsimWorld directly if they have any questions before making use of their moderator privileges. Publishers and like representatives (designers, developers, playtesters, etc.) acting as topic moderators are encouraged to accept and not censor any negative product criticism in order to better promote open and independent debate using the ConsimWorld Forum services.
• ConsimWorld does not actively monitor discussion areas, and it does not intend to engage in any prior review of notes posted to discussion areas. consimworld.com reserves the right in its sole discretion to delete or redirect any information or other content uploaded to consimworld.com (including uploads to discussion areas), regardless of whether the information or other content violates the rules for content described in these policies.
• Disputes of a legal nature are not an appropriate topic for ConsimWorld by any parties directly involved regarding any ongoing legal dispute. Non-parties may discuss a pending legal dispute (subject to their own personal compliance with defamation laws), but ConsimWorld is not an appropriate forum for the parties to argue the merits of their relative legal positions.
• Participants may not upload to consimworld.com any copyrighted material (including photographs, video, animation, text, software programs, graphics or sound files) without the express written permission of any copyright owner or the owner's agent. Only the owner or a representative designated by the owner may upload copyrighted material to consimworld.com. consimworld.com reserves the right to remove immediately any material that it believes may violate any copyright or third-party rights.
• By submitting material to consimworld.com discussions, a participant asserts that the material is his or her own, is licensed to be uploaded and downloaded by other participants, is in the public domain, or is otherwise free of copyright or other restrictions. The participant also grants consimworld.com and ConsimWorld an irrevocable, nonexclusive, royalty-free license to redistribute or republish the information in any medium or form.
• ConsimWorld reserves the right to move or delete any postings or topics without notification nor warranty of archiving/saving said contents.
• ConsimWorld is not responsible for any loss of data resulting from but not limited to database corruption, software virus, or any technical problems that may occur during the course of normal operation.
• ConsimWorld membership or becoming a participating publisher, or guest, is a privilege. Consimworld.com reserves the right at any time to limit or terminate service to any member or participating publisher for any reason, including but not limited to a violation of any provision of this User Agreement and Operating Policies, at the sole discretion of ConsimWorld. When such action is taken, ConsimWorld may contact the party directly to explain any such action taken.
• Participating publishers are considered guests of ConsimWorld. There is no express warranty as to the availability of services which may be offered to participating publishers, including but not limited to newsdesk coverage, forum topic support, and any other services ConsimWorld may be able to provide to participating publishers. ConsimWorld reserves the right to limit or withdraw services offered to participating publishers at any time, with or without cause.
• Participating publishers are guests of ConsimWorld and are required to provide one(1) complementary product at time of produce release, including but not limited to any games or literature (including but not limited to magazines, modules, playaid sets, etc.). A participating publisher who does not furnish ConsimWorld with complementary product within sixty (60) days of the individual product release date is considered to be in violation of this user agreement.
